1. Introduction
LeisureBoost is a trading name of The Tech Factory LTD. By engaging with our services, you agree to the terms and conditions outlined in this document. These terms govern the provision of Facebook Ad Marketing services, website design and hosting, and social media marketing services provided by LeisureBoost. By signing up for our services, you acknowledge and accept these terms in full.
2. Services Provided
LeisureBoost offers Facebook Ad management, social media marketing, web design, and website hosting services for businesses within the leisure and hospitality industry.
2.1 Facebook Ad Management
Our Facebook Ad management service includes:
- Campaign strategy and planning
- Ad creation and management
- Audience targeting and optimisation
- Performance analysis and reporting
2.2 Social Media Marketing
We provide social media management, including content creation, scheduling, engagement strategies, and paid social campaigns.
2.3 Web Design & Hosting
We offer professional web design and secure hosting solutions tailored for leisure and hospitality businesses.
Additional services may be provided as agreed upon in writing.
3. Payment Terms
- All payments must be made in full before work commences, unless otherwise agreed.
- Monthly retainers are billed in advance and are non-refundable, except under the terms of our Risk Reversal Policy.
- Late payments may result in service suspension until payment is received.
4. Client Responsibilities
To ensure effective service delivery, the client agrees to:
- Provide all necessary access to ad accounts, websites, and relevant marketing assets required to implement our strategy to maximise performance.
- Ensure compliance with Facebook’s advertising policies and other relevant advertising platform regulations.
- Respond to LeisureBoost’s communications in a timely manner.
- Failure to meet these responsibilities may affect the effectiveness of our services and could void our 4x ROAS Guarantee.
5. Performance & Results
While we strive to deliver outstanding results, LeisureBoost does not guarantee specific outcomes or return on investment. Ad performance is influenced by factors such as:
- Market conditions
- Industry competition
- Audience behaviour
- The effectiveness of the client’s booking process, pricing, and customer service
We do, however, offer a 4x ROAS Guarantee under the conditions outlined below.
6. Risk Reversal Policy & 4x ROAS Guarantee
LeisureBoost is committed to delivering exceptional results for our clients. To demonstrate our confidence in our services, we offer a 4x Return on Ad Spend (ROAS) Guarantee.
6.1 Guarantee Terms
- If, after five months of active campaign management, a client does not achieve at least 4x ROAS, we will refund 100% of our management fees for that period.
- ROAS is calculated as: (Revenue Generated from Ads) ÷ (Ad Spend) = ROAS
- The 4x ROAS is measured across the full five-month period, not on an individual campaign basis or a specific month.
6.2 Eligibility Requirements
To qualify for the guarantee, the client must:
- Meet our minimum eligibility criteria to qualify for the guarantee – this will be discussed with you first, and agreed in writing.
- Commit to a minimum five-month period, allowing sufficient time for campaign optimisation.
- Allow us to implement all recommended actions, including changes to ad creatives, targeting strategies, budget allocations, and landing pages.
- Maintain the agreed advertising budget throughout the five-month period.
- Ensure conversion tracking is correctly set up and that their website or booking system is functional.
- Not interfere with the campaign by pausing ads, changing budgets, or altering creatives without consultation.
Failure to meet these requirements will void the guarantee.
6.3 Refund Claim Procedure
If, after five months, you believe you qualify for a refund under the 4x ROAS Guarantee, the following steps apply:
- Submit a written request within 14 days of the five-month period ending.
- LeisureBoost will review the campaign performance, strategy execution, and client compliance.
- If eligible, a 100% refund of our management fees will be issued within 10 business days.
Note: Ad spend paid directly to Facebook is not covered under this guarantee.
6.4 Exclusions & Limitations
The guarantee does not apply in the following cases:
- The client fails to implement or approve recommended strategies, changes, or optimisations.
- External factors (e.g., economic downturns, product supply issues, or force majeure events) impact campaign results.
- The client modifies, pauses, or interferes with the campaigns without prior consultation.
- Facebook suspends or bans the client’s ad account due to policy violations.
- The client fails to provide accurate business data or adhere to advertising platform policies.
7. Indemnification
The client agrees to indemnify, defend, and hold harmless LeisureBoost (The Tech Factory LTD) from any claims, damages, or losses arising from:
- Non-compliance with advertising platform policies.
- Legal disputes related to the client’s business or advertisements.
- Inaccurate information or materials provided by the client.
- Third-party claims related to our services.
8. Service Termination
LeisureBoost reserves the right to terminate services immediately in the event of:
- Non-payment of invoices.
- Violation of these Terms & Conditions.
- The client’s involvement in fraudulent or illegal activities.
If a client wishes to cancel services, a 30-day written notice is required.
9. Limitation of Liability
LeisureBoost shall not be liable for:
- Indirect, incidental, or consequential damages (including lost revenue or business disruption).
- Failure to achieve specific business results, beyond the terms of our 4x ROAS Guarantee.
- Any loss incurred due to platform policy changes, technical failures, or force majeure events.
Our liability is strictly limited to the fees paid for our services.
10. Amendments & Updates
LeisureBoost reserves the right to update these Terms & Conditions at any time. Clients will be notified of significant changes, and continued use of our services constitutes acceptance of the updated terms.
11. Agreement to These Terms
By engaging with LeisureBoost’s services, you acknowledge that you have read, understood, and agreed to these Terms & Conditions in full.
